If you have recently lost a loved one, you will be required to take care of their assets, property, and debts through a process called probate or estate administration. Assets solely in the name of the decedent are probated. Other assets may pass by operation of law outside of probate such as real property owned jointly by spouses, by contract, such as life insurance and certain retirement plans such as IRA accounts, 401K Plans, etc; or because of special legal classifications such as homestead property. If the decedent did not have a will or other estate planning documents, the probate is resolved through laws called intestate laws.
